TYSON, JUDGE William Glen Boyd was charged in an eight-count indictment with the capital murders of Fred and Evelyn Blackmon. Four counts
of the indictment charged the appellant with murder during the course of a kidnapping, and the other four counts charged him
with murder during the course of a robbery. The jury found the appellant guilty on each count of the indictment. At the sentence
phase of the trial, the jury recommended that the appellant be sentenced to life without parole by a seven to five vote. The
trial Judge rejected the jury's recommendation and sentenced the appellant to death.
